Data Processing Agreement
A must-have agreement for businesses that share personal data with third parties as part of their operations.
It is a legal requirement under UK GDPR to have a Data Processing Agreement in place whenever a data controller instructs a data processor to process personal data on its behalf.
This means that when you engage a third-party service provider who needs to access and process personal data on your behalf, you should have a DPA in place alongside your Services Agreement with that provider.

Activities classed as processing personal data can be as simple as sending emails to a mailing list, conducting web analytics or storing personal data on external servers.
As a data controller under UK GDPR, you are responsible for compliance with the legislation in respect of your own systems and processes, as well as ensuring that your processors meet their obligations.
This agreement contains the minimum required terms stipulated in Article 28 of UK GDPR and outlines how your processors must handle personal data to remain compliant with the legislation.
Without a DPA in place, you could face additional scrutiny from the Information Commissioner’s Office if a personal data breach occurs involving one of your service providers.
