Arguably, getting a trade mark is the easy part. The really important element of owning a trade mark is enforcing the rights it provides your business. It is important therefore that you take regular monthly steps to ensure that no-one is infringing the intellectual property rights of your business.
It's also important that you closely monitor any correspondence that comes in from the Intellectual Property Office as they send alerts if anyone attempts to apply for a similar trade mark.
The deadlines are strict and if you miss the deadlines without objecting to new applications, that trade mark will be granted and it can be quite costly to overturn them.
In order to support you, we offer a
Trade Mark Representation Service
This service means that the Lucy Legal name and contact information is stored with the trade mark office so that we get alerted if anyone applies for a similar trade mark.
Our name may act as a deterrent to others trying to apply for a mark which is too similar to yours.
If you choose to keep the representation through Lucy Legal we will:
1. Manage all correspondence in from the trade mark office
2. Alert you promptly of any new applications and provide you with an initial view on whether you should oppose the new application.
3. Provide you with a discount on future trade mark applications which we manage on your behalf.
We can even manage multiple trade marks on your behalf so that you don't need to worry about missing the correspondence or responding within the deadlines.
T&Cs - What you need to know about your subscription
Simply set up the monthly subscription for ongoing support by selecting your subscription option below.
If we have managed the trade mark application for you the representative service will begin the day you complete your purchase.
Our prices are inclusive of VAT and you will receive a reduced price for the representation on additional trade marks within your portfolio.
The subscription will renew on the same date each month. If you would like to end the subscription for any reason simply let us know. There is no minimum subscription period, you can unsubscribe at any time; please email us at [email protected] and we will arrange for a transfer of representation to you.
If you change your mind within the first 14 days of your subscription simply let us know and we will provide a refund. Refunds will be managed in accordance with your statutory rights.
If we haven't managed the trade mark application for you please email [email protected] before purchasing so that we can confirm that we are not conflicted and file the necessary paperwork with the trade mark office.
